Who this policy covers

Tomisha Studios develops and publishes the mobile games Near Miss Runner and Hue Shift. In this policy, “Tomisha Studios,” “we,” “us,” and “our” refer to the publisher of those games.

This policy applies to current and future versions of both games distributed for Android, iOS, Windows, and other supported platforms. Available features, permissions, and third-party services may vary by platform and release. This policy explains information processed directly on your device and information that may be processed by services integrated into the games.

03 · Information handling

What may be processed

Information we do not ask you to provide

The games do not create user accounts and do not ask for your name, email address, telephone number, contacts, precise location, photos, camera, or microphone. They do not contain chat, multiplayer communication, or user-generated-content features.

Information stored on your device

Each game may store gameplay progress and preferences locally, including scores, achievements, unlocked items, game settings, notification preferences, and similar gameplay state. This information is not uploaded to a Tomisha Studios server.

Information processed by advertising services

Google Mobile Ads and its advertising partners may automatically process information such as your IP address, device and app information, advertising identifiers, consent choices, approximate location inferred from IP address, diagnostic information, and your interactions with advertisements. The exact information depends on your device, region, consent choices, and Google’s configuration.

Support communications

If you email us, we receive the information you choose to include, such as your email address, game name, device details, and description of the issue. We use it only to respond, troubleshoot, protect our services, and maintain appropriate support records.

04 · Advertising and consent

Google AdMob

Both games use Google AdMob to display rewarded and interstitial advertisements. Rewarded advertisements are initiated by the player in exchange for an in-game benefit. Interstitial advertisements may appear at appropriate breaks in gameplay.

Where required, the games use Google’s User Messaging Platform to request or manage consent before advertising services initialize. Your available choices can vary by location and applicable law. Google and its partners may use information to deliver, limit, personalize, measure, and protect advertising, subject to your consent choices and their policies.

05 · Purposes and legal bases

Why information is processed

Information is processed as necessary to operate game features, remember local progress and settings, provide requested support, display and measure advertisements, prevent fraud and abuse, comply with legal obligations, and manage privacy choices.

Depending on your location and the activity involved, processing may rely on your consent, performance of a service you request, compliance with legal obligations, or legitimate interests such as maintaining security, answering support requests, and improving reliability. You may withdraw consent through the available privacy controls without affecting processing that occurred before withdrawal.

06 · Sharing and international processing

Who receives information

We do not sell your personal information. Information may be processed by Google and its advertising partners when AdMob and the consent platform operate. Support email may be processed by our email provider. We may also disclose information when reasonably necessary to comply with law, protect rights and safety, investigate abuse, or respond to lawful requests.

Third-party providers may process information in countries other than yours. Their processing, security measures, retention periods, and international-transfer safeguards are governed by their own terms and privacy policies.

07 · Storage and retention

Local-first game data

Local progress remains on your device until it is removed through the game, cleared through your device or platform settings where available, or deleted when you uninstall the game. Tomisha Studios cannot retrieve local game progress after it is deleted.

We retain support correspondence only for as long as reasonably necessary to answer the request, maintain continuity, prevent abuse, and meet applicable legal requirements. Information processed by Google is retained according to Google’s policies and your account or advertising settings.

08 · Your choices

Controls available to you

• Consent: Use the consent message or privacy-options entry shown in the game, where available, to review your advertising choices.
• Device advertising controls: Review or reset advertising settings through your Android or Google account settings.
• Notifications: Decline notification permission, disable reminders inside the game, or turn them off through your device or platform settings.
• Local data: Clear the game’s storage through your device or platform settings, where available, or uninstall it to remove locally stored progress and preferences.
• Support data: Contact us to ask about information contained in support correspondence.

09 · Children’s privacy

Designed for ages 13 and over

Near Miss Runner and Hue Shift are not designed for children under 13, and their selected Google Play target audiences exclude users under 13. We do not knowingly request personal information from children under 13. If you believe a child has provided personal information directly to us, contact us so we can investigate and take appropriate action.

10 · Security

Protecting information

We minimize the information handled directly by the games and rely on established platform and service-provider protections for network communication. No method of electronic transmission or storage is completely secure, so absolute security cannot be guaranteed.

11 · Your privacy rights

Access, objection and deletion

Depending on where you live, you may have rights to request access, correction, deletion, restriction, portability, or information about processing, and to object to certain processing or withdraw consent. You may also have the right to complain to your local data-protection authority.

Because we do not operate player accounts or a player-data server, most gameplay data can only be managed on your device. For support correspondence or questions about our practices, email us. For information controlled independently by Google, use Google’s privacy tools or contact Google directly.

12 · Changes

Updates to this policy

We may update this policy when game features, service providers, or legal requirements change. The latest version will remain available at this URL, and the effective date at the top will be revised when material changes are published.
